Transfer ownership of strata titles


I'm pretty sure few owners had done the transfer. But nevertheless, few owners still in the process of getting the right lawyer to do the job. As stated in the letter by developer dated 15 July 2011, we're supposed to execute the transfer within 12 months.

So, just for a quick references, following are some info I gathered about the process.

What is transfer ownership of strata title?

(1) Any original proprietor or any person or body appointed by a court of competent jurisdiction shall execute the transfer of strata titles to the parcel proprietors within twelve months from the date of issue of strata titles by the Land Administrator or any extended period approved by the Director upon the opening of the strata register.


(2) Any purchaser shall execute complete documents of transfer of strata titles within twelve months or any extended period approved by the Director from the date of notice of transfer of strata titles issued by the original proprietor or from the date of purchase of the parcel, whichever is the later.

(3) Any original proprietor or any person or body appointed by a court of competent jurisdiction or any purchaser who fails to comply with subsection (1) or (2) shall be guilty of an offence and shall, on conviction, be liable to a fine of not less than one thousand ringgit and not more than ten thousand ringgit per parcel.

What are the documents that you must provide to your lawyer?


  • Copies of all present and previous Sale & Purchase Agreements (if you are not the first purchaser, to show proof that you are the last buyer in the chain).
  • Copies of present and previous Loan Agreement, Deed of Assignment, Deed of Receipt and Re-assignment (if any). 
  • Strata Title (from the developer)
  • Current year quit rent receipt.
  • Current year assessment receipt.

How much to pay for the transfer? 
Basically 2 main cost involved which are the legal fee and stamp duty. So far, based on
priced quoted is around RM7k-RM8k.
I'm thinking we could form a group purchase so that we could obtain more competitive fee charged by lawyers. If you've choosen any particular law firm or you're personally know or worked as lawyer, feel free to contact me.
So, owners, please send in your contact if you plan to join in this group before 19 February 2012. At the moment, time is essense, as for execution it took around 3-4 months.
Hopefully we can get it done before the due date this July 2012.

Hi guys, looking at the group signing of strata title. How much do we save on the legal charges? The stamp duty should be fixed.

Pls find the original lawyer who done your SnP because the legal fee is cheaper by 50%.. the cost will not be dat high..

Thanks for your info. Any idea how much total fee saved on that? Have you done the transfer?

Dear moderator,
it's about 3k mar.. not 7-8k.. btw I dont recommend my lawyer because it's very slow and not responsible... (taiji master). why i use them because the firm perform my SnP.. so I can save abt 1k+ on this..

I can recommend 1 lawyer firm, I got their quote and I find that it's very reasonable.. their charge on the miscellaneous is very cheap..

Issac, possible to share your quotation. Have you done both transfer and charge? As i know, Stamp duty is fixed for all firm. The only fee they can nego is the service charge by lawyer. As for the disbursement, it is ranged from RM360 to RM500. The lower the purchase price and loan amount, the lower for both transfer and charge. For a unit with price tag of RM250K, the stamp duty for transfer already RM3980.

oh i understand now... cos I no need to pay stamp duty as I have already paid when i purchase the house from sub-sales market... my quote is for the legal fee only for the transfer process.

My unit 245k, the quoted fees for MOT + stamp duty, total everything is 5.1k. Is this reasonable? Anybody else got cheaper? Yes, the stamp duty already is almost 4k.. wonder how much more we can save.. thanks guys...

So for lawyer fee and etc charges cost around RM1.1k. Quite reasonable. How about MOF? charged to the bank? Usually around RM1-1.5k.
